Absent spouse divorce: you can divorce a spouse whose address is unknown in the Netherlands. The only ground is that the marriage has irretrievably broken down (Article 1:151 of the Dutch Civil Code, BW), and you do not need your spouse’s consent or presence. The key exception: the court only proceeds once you show a thorough search and the petition has been served publicly via the public prosecutor and the Government Gazette (Article 54(2) of the Code of Civil Procedure, Rv).
The procedure takes longer than an ordinary divorce, but the result is the same: a court order that dissolves the marriage once it is entered in the civil register. This article explains jurisdiction, the search the court expects, public service, and how money and children are dealt with when your spouse is absent.
When does a Dutch court have jurisdiction?
Under the EU rules on divorce jurisdiction (Brussels II ter Regulation), a Dutch court can hear your petition if, among other grounds, you have lived in the Netherlands for at least one year before filing, or for at least six months if you are a Dutch national. Both spouses having Dutch nationality is also a ground, wherever you live.
Other grounds apply too, for example if the Netherlands was your last joint habitual residence and you still live here. Check jurisdiction before you start: if it is missing, the court cannot hear the case and the time spent on the search is lost.
How does a unilateral divorce petition work?
Your lawyer files a unilateral divorce petition (eenzijdig verzoek tot echtscheiding) with the district court. Under Article 815(1)(a) Rv the petition must state your spouse’s address and actual residence “as far as known”; if they are unknown, the petition says so and explains the search.
The divorce is no-fault. You only have to state that the marriage has irretrievably broken down; a spouse who has disappeared for a long time rarely leaves room for doubt. Our Išsamus vienpusių skyrybų vadovas explains the general procedure.
How do you document your search for a missing spouse?
The court must be satisfied that your spouse’s address and actual residence are really unknown before public service is allowed. Build a file that proves a reasonable, documented search; the court expects effort, not success.
Start with official Dutch records
Request an extract from the Personal Records Database (BRP) from the municipality. If your spouse was deregistered as “departed to unknown destination” (vertrokken onbekend waarheen, VOW), that extract is key evidence. Keep every request and reply, including replies that say no data were found.
Contact family, friends and former addresses
Write to family members, mutual friends, former colleagues, landlords and neighbours, preferably by registered post or email so you have proof. Ask people with information for a short signed statement. In complex cases a preliminari liudytojų apklausa can secure sworn testimony.
Search abroad when relevant
If your spouse may have left the Netherlands, contact the embassy or consulate of their home country and check foreign public records where available. A report from a licensed private investigator, describing the methods used, is useful evidence. If you find an address abroad, the petition must be served there, for example under the Hague Service Convention, and public service is no longer possible.
| Search step | Įrodymai, kuriuos reikia saugoti |
|---|---|
| BRP extract from the municipality | Extract showing last address or VOW status |
| Family, friends, colleagues | Registered post receipts, emails, screenshots, signed statements |
| Last known address, landlord, neighbours | Dated notes of calls, copies of letters |
| Internetinė ir socialinė žiniasklaida | Dated screenshots of searches and messages sent |
| Abroad (embassy, foreign records, investigator) | Correspondence and investigator’s report |
How is the petition served on a spouse who cannot be found?
A bailiff (gerechtsdeurwaarder) first tries to serve at the last known address. If both the domicile and the actual residence are unknown, Article 54(2) Rv prescribes public service in two steps.
First, the bailiff serves the document at the office (parket) of the public prosecutor at the court that will hear the case. Second, an extract is published in the Government Gazette (Staatscourant) as soon as possible, stating the name and office address of the bailiff or lawyer from whom a copy can be obtained. A newspaper advertisement has no legal effect of its own.
Public service is only allowed if the address is genuinely unknown. If it later turns out that a traceable address was overlooked, the service can be set aside and the procedure may have to be repeated.
How does the court decide if your spouse never responds?
Divorce is a petition procedure, so there is no default judgment as in summons proceedings. If your spouse files no statement of defence within the period, the court decides on the basis of your petition and your evidence, and gives a court order (beschikking) dissolving the marriage.
The divorce takes effect only when the order is entered in the civil register (Article 1:163(1) BW). That must be requested no later than six months after the order has become final; otherwise the order loses its force and you are still married (Article 1:163(3) BW). Because your spouse did not appear, the three-month appeal period for your spouse runs from service of the order or the moment it otherwise became known to them, under Article 806(1)(b) Rv, so the order must be served (publicly, if necessary) before it becomes final.
How are property, maintenance and children dealt with?
You can ask the court to decide on the division of property, maintenance and parental authority in the same procedure. Put all requests and all known facts in the petition, because your spouse will not supply them.
Division of the community of property
If you married without a prenuptial agreement, you are in a community of property. Under Article 1:100 BW each spouse is entitled to an equal share. For marriages since 1 January 2018 the ribota turto bendrija applies, so assets from before the marriage and most gifts and inheritances stay outside it.
List all known assets and debts, including foreign property, bank accounts and pensions. Use a valuer for the home or a business. A Dutch order that omits a known foreign asset may leave you divorced but still financially tied to your ex-spouse.
The court’s division binds you and your spouse, not your creditors. If you are jointly liable for a mortgage or loan, the bank can still claim the full amount from you. Contact your lenders with the court order after the divorce.

You can request spousal and child maintenance in the petition. Give the court as much information as possible about your own needs and income, your spouse’s last known income and earning capacity, and the children’s costs. An order is the basis for collection if your ex-spouse or their assets are found later.
Parental authority and the parenting plan
A divorce petition with minor children must normally include a parenting plan signed by both parents (Article 815(2) Rv). If that is reasonably impossible, Article 815(6) Rv allows the court to accept other documents instead; explain why the plan is missing.
Joint authority continues after divorce. Under Article 1:251a(1) BW the court can grant sole authority to one parent if there is an unacceptable risk that the child is caught between the parents without prospect of improvement, or if the change is otherwise necessary in the child’s interest. A parent who has disappeared is a strong reason to ask. See our guide to Vaikų globos įstatymai Nyderlanduose.
What are the common mistakes?
- A search that is informal or undocumented: a few social media messages are not enough.
- No BRP extract: it is the basic proof of the last registered address or VOW status.
- No search abroad where your spouse has foreign ties.
- Public service while an address could have been found, which makes the service vulnerable.
- Foreign assets and pensions left out of the petition.
- Forgetting to register the final order within six months, so the divorce never takes effect.
What should you check before filing?
- Check that a Dutch court has jurisdiction: your residence period and nationality.
- Collect the BRP extract and proof of every search step.
- List all assets, debts and pensions, in the Netherlands and abroad.
- Decide which requests to add: division, maintenance, sole authority.
- Prepare an explanation of why a joint parenting plan is impossible.
- Diarise the six-month deadline for registration after the order becomes final.

How long does a divorce from an absent spouse take?
Usually longer than an ordinary divorce, because of the search, public service and the appeal period that runs from service of the order. Many cases take six to twelve months after filing; a search abroad can add time before you file.
What if my ex-spouse reappears after the divorce?
A spouse who was served publicly can still appeal within three months after the order was served or otherwise became known to them (Article 806(1)(b) Rv). Once the order is final and registered, the divorce stands. If public service turns out to have been unjustified because an address was known, the service can be challenged.
Can I divorce a foreign spouse who has left the Netherlands?
Yes, if a Dutch court has jurisdiction, for example because you have lived here for at least one year before filing (six months if you are Dutch). If you find an address abroad, the petition must be served there instead of publicly.
What happens to our joint debts?
The court divides community debts between you, but that division does not bind creditors. If you are jointly liable for a loan or mortgage, the lender can still claim the full amount from you; contact your lenders with the court order.
Do I need a parenting plan if my spouse has disappeared?
A parenting plan signed by both parents is normally required, but under Article 815(6) Rv the court can accept other documents if a plan reasonably cannot be submitted. Explain in the petition why it is impossible.
